Compulsory purchase

Compulsory purchase is a vital tool to help public authorities deliver development opportunities that are in the public benefit.

What do we do?

Our legal and property professionals are market leaders in advising on Compulsory Purchase Orders (CPOs) from both a legal and property perspective. The planning lawyers within Gateley Legal regularly advise clients on compulsory purchase and compensation law. Take a look here at the planning law expertise that they bring. The surveying experts within Gateley Hamer regularly advise on the promotion and implementation of CPOs and assembling land by agreement, acting for scheme promoters (i.e. acquiring authority or developer) and affected landowners from initial consultation through to settlement of compensation claims. And throughout each stage of a project we help our clients to deliver projects whilst creating significant cost savings and minimising risks.

What is a Compulsory Purchase Order?

In certain circumstances the government, councils or other public sector bodies have the right to compulsorily acquire land from private owners. These acquiring bodies must meet statutory tests in order to exercise such rights, demonstrating that the scheme that the acquisition will facilitate is in the public interest. CPOs are commonly used to advance projects such as town centre regeneration, housing renewal and other forms of development. Any party who has had land acquired under a CPO is usually entitled to compensation.

How we help scheme promotors

We advise acquiring authorities and developers on CPOs for housing and regeneration projects, Transport and Works Act Orders, Highway Orders and Development Consent Orders throughout the UK. Our services include:

  • Landowner and statutory consultation
  • Negotiation of access licences for surveys
  • Valuations for property cost estimates
  • Negotiation of option and compromise agreements
  • Expert witness services at public inquiries, hearings and at the Upper Tribunal
  • Development and implementation of acquisition strategy
  • Negotiation and settlement of compensation claims.
The plans for each Housing Zone have advanced considerably over the course of the commission. This is to the credit of Gateley Hamer and they have left a strong platform for further progress. I have no hesitation in commending their work and the contribution of the lead consultant Malcolm Newman at Gateley Hamer and recommend them for similar commissions.
